Using conditions for sellers and visitors of our communication-platform “CAMWORLD.TV”
“CAMWORLD.TV” is an association of a multitude of domain-names for running a chat- and
community-system (called “owner” in the following)
For each added site the specific site-owner is responsible for the content on his own.
Chat host (called “seller” in the following)
§ 1. Subject-matter of contract
a)The owner has developed a system for interactive communication in digital networks which makes it
possible for the internet-user (called “user” in the following) by direct picture transmission to look at
artistic, erotically or other performances of a multiple choice of sellers. This system is called
“CAMWORLD.TV”. The owner makes therefore a platform available in the internet by using different
domains, by this, the seller can present himself to the user and they can get in contact either by chat or
telephone.
b)The seller is acting for the owner as a performer on free payment.
c)The seller is making a striptease and / or a conversation with sexual contents. How they make the
striptease and the conversation depends on the seller- temporarily and in its contents on his own.
d)The transmission of the striptease happens by online-networks, the conversation happens by
telephone.
e)The seller is interested to offer his performance in the system of “CAMWORLD.TV”.
f)The telephone connection, the telephone set and the personal computer hardware as well as the
internet connection has to be placed at disposal by the seller.
§ 2. Legal order, Consideration
a) The owner places the platform at disposal for the contact between seller and user and undertakes the
support of marketing, technical support, the settlement and collection. The contract of erotically
performances is therefore signed between seller and internet-user.
b) The seller is doing his performances at his personal location which can be in Germany or abroad.
c) The owner is collecting the data of the users for the seller for the purpose of settlement. This is
including especially access data, IP – Number and time of stay in the system of the concerning seller
with date and exact time.
d) The owner is allowed to save all the called data explained in § 2 c) by keeping the data protection
law.
e) Although the contract is signed between seller and user the owner is allowed to protocol the chats.
Nevertheless the owner does not undertake the obligation of controlling the legal regulation.
§ 3. Performance of the owner
a) The owner places the platform and the so called “Sender software” at disposal, through this the seller
can transmit his live stream to the user. The owner gives the seller the simple right for using the
system and the “Sender software” during the term of the contract. This means, that this system may
only be used for performances in correlation with “CAMWORLD.TV” (and connected affiliate partners)
and the right for using is ending up with the end of the contract.
b) Picture-, live stream-, sound- and graphic material in any form, which is placed at disposal by the
owner is under copyright of the owner. The owner gives the right of using “CAMWORLD.TV” to the
seller only for performances on his own and not for any other persons.
c) The owner has a computer, which is connected to the internet (web server) on which the system
“CAMWORLD.TV” is installed. Users who have got an internet connection can get free information
through this web server 24 hours a day. The user can get in contact with the seller and after this the
user can treat for the kind and content of the performance with the seller.
d) The technical connection between seller and user is accomplished directly between seller and user.
The owner does protocol each chat and has no influence on the quality of the connection between seller
and user.
e) The owner is charging the produced amounts, takes his commission away and after this he is paying
the seller. The details of the commission are explained further down at “payment”.
f) The owner is checking the age of the user by technical measures.
§ 4 Performances of the seller, taxes
a) The seller owes a commission to the owner – explained further down by “conditions and settlement”.
b) The owner is allowed at any time to change the terms “conditions and settlement”. The seller has to
be informed by the owner in writing at minimum 5 working days before changing. An email is therefore
enough.
c) The seller is responsible for paying taxes for his produced amounts on his own.
d) The seller is responsible for a legal book-keeping.
e) The payment of earnings is the result of a correct credit item.
f) The seller commits not to entice any users away from the sites of the owner or his contract partners.
It is not allowed to tell the user any emailadresses, 0909-phone numbers, or domains which contain
similar contents and compete with the offers of the owner and his contract partners.
The owner will control this by doing arbitrary test calls by authorized persons. Acting contrary to this, a
contractual penalty to the amount of 2.500 € (in words: Twothousandfivehundred Euro) will be payable.
The seller will be removed from the system immediately and the expected returns will be retained to
the height of the contractual penalty.
g) The seller transfers the exclusive and unrestricted right to use of all picture-, video-, sound and
graphics material to the owner, which are placed at disposal by the seller during his participation at
“CAMWORLD.TV”.
h) The seller releases the owner from today on from any legal effects which could be the result of
spreading any picture-, video-, sound- or graphics material of the seller in any form. The seller does
agree that the owner is not able to exclude the spreading by unauthorized persons.
§5. Copyright, Assignment of Rights
a) The owner sets up a collection of private video live streams and pictures. This collection shall not
only be used in internet but also in other media. It is necessary for “CAMWORLD.TV” that the owner may
use the work of the seller all alone.
b) The seller transfers all the rights to the owner for official presentation, video, synchronization,
telecommunication, sound carrier, merchandising, printing, advertising, festival- and fair, archives, the
right of titles and format, the using of video, CD-ROM, TV, Internet- and Print media. The owner is
allowed to use the seller’s works in any kind without paying the seller a special consideration.
§6. Prohibition of illegal pornography, Contractual Penalty
a) The System of “CAMWORLD.TV” is especially from adults for adults.
For economic success and reputation it is essentially necessary for the seller to observe the legislative
rules. This contains especially the prohibition of pornography involving children and animals as well as
the glorification of violence.
b) The owner will control the observance of these prescriptions from time to time.
c) As soon as the owner realizes an offence against these prescriptions, the seller will be removed from
the system and the occurrence will be reported to the police.
d)For each offence against the prohibition of illegal pornography the seller has to pay a contractual
penalty of Euro 5.200,-- to the owner.
e) The owner will also report every seller to the police, who offers illegal pornography in the system of
“CAMWORLD.TV” or who offences against the legislative rules.
§7. Users
a) Each user has to do an age check before using the performances through this he has to prove that he
has attained his majority. The using of performances with costs is only possible after the age
verification.
b)The user is responsible for his identification name and password which he can choose on his own.
c) In case of loss or supposed abuse, the user is obliged to tell this to the company immediately.
§8. Exclusion of liability
a) The company is responsible for damages which were produced by himself or his employees by gross
negligence or intentionally. The responsibility for foreseeing and direct damages at a breach of
obligations of the contract, is restricted to € 1.000,-- in cases of simple carelessness. Otherwise the
responsibility is expelled as far as it does not concern personal damages.
§9. Duration of contract, notice of termination of agreement and its results
a) The owner is not obligated to accept a new registration.
b) The contract is made for an indefinite time. It can be cancelled in writing by both contracting parties
without observing a term. A declaration of reasons is not necessary.
c) The right of notice without notice because of important reasons stays untouched. A reason for a
notice without notice by the owner exists especially if the seller is not of full age or if he makes it
possible to enter the system of “CAMWORLD.TV” to non-major persons, or if the seller offers illegal
pornography – especially pornography with children or animals, or if the owner gives up the
management of “CAMWORLD.TV” because of economical reasons.
d) After finishing the contract the seller is engaged to give back all materials, which have been made
available to him by the owner, and to delete all eventually made copies. After finishing the contract the
seller is no more allowed to offer any performances in the name of “CAMWORLD.TV”.
e) If this contract is finished because of an offence against the regulations of the contract or because of
common criminal offences in connection with the using of “CAMWORLD.TV”, the result is that all
amounts which have not been paid yet, will not be paid.
§10. Applicable rights, legal domicile
a) The contract is based on German laws. Domicile for all obligations of contract is the seat of the
owner.
b) If the seller is a businessman than the local courts of the owner are responsible.
c) It is possible for the concern to bring an action against the seller – if he is a businessman – at the
place of his residence or place of business.
§11. Others
a) Changing or additions of the contract are only valid if they are made in write. This is also valid for a
changing of the writing clause.
b) If one or more regulations or a future regulation of the contract are / becomes wholly or in part
inoperative or if the contract should contain a gap which has to be filled, it does not touch the efficacy
of the remaining regulations. If the contract contains a gap or an inoperative regulation then this
regulation will be replaced by a regulation which becomes more reconciled to economic and legal
purpose to the regulation.
c) By using the system “CAMWORLD.TV” and the transfer of the pictures the seller accepts this contract.
He assures that he was referred to this contract by the owner at the registration.
§12. Conditions and settlement
1. Item of the regulation
The following conditions regulate the using of the service number 0909 of the owner for Inland service
by the seller as well as condition and accountancy of the produced turnovers. The two parties agree
that the owner has only the function of procurement and accountancy. The contracts which are reached
because of the using of the so called 0909 number and other accountancy systems are only connecting
the seller and the caller or internet user.
2. Performance data
a) The owner makes a 0909 service number available to the seller. The seller uses this number only for
analogue telephone conversation. The seller has to accept the conditions of the German Telekom.
b) These service numbers are routed to a telephone connection of the seller by the owner. The seller
does not claim any rights to the service numbers.
c) The seller will get a consideration for his performed phone minutes according to point 4.1)
d) The service number is made of the number 0909 and the distributed phone number.
3. Obligations and duties of the seller
The seller is especially obligated to
a) act according to the obligations and duties of the common business conditions of the German
Telekom or their legal successors and to omit punishable acts, which are:
- § 130 penal code (public inciting)
- § 130 penal code ( instruction to criminal offence)
- § 131 para 1 penal code (presentation of violence)
- § 86 penal code (spreading of propaganda of unconstitutional organisations)
- § 87 penal code (agent activities for the purpose of sabotage)
- § 184 penal code (spreading of pornography)
- §§ 29ff. law of narcotic
- §§ 284, 286 penal code (non allowed organization of gambling and lottery)
b) tell the owner all breakdowns immediately
c) answer all phone calls personally – answering systems for 0909 service numbers are not allowed
d) answer all incoming calls when the seller is online
4. Payment
4.1) Payment of phone calls
a) for acceptance of a call, the seller gets a consideration according to the fulfilled phone call minutes,
this means for each minute:

b) In general the seller only has the right to get a consideration from the owner if the German Telekom
or their legal successors pays the owner, whereas the owner has the accountability to prove the
eventual failure of payment.
c) If payments of the German Telekom or their legal successors should be cancelled subsequent, the
cancelled amount will be proportionately passed to the sellers account.
d) Settling day is the 15. of the following month. Payment is happening by cheque within one week after
settling day. If the payment by the German Telekom or their legal successors should be delayed,
payment for the seller will move correspondingly.
e) Changing of the common business conditions and prices will be told to the seller in writing. The
changing seem to be accepted if the seller does not terminate the contract within the following four
weeks.
f) About that the owner is allowed to change his payment if the German Telekom or their legal
successors change their payings.
g) If the service number is routed to mobile phone, and/or abroad the paying per phone minute is
reduced as following:

4.2) Consideration of other payment possibilities
a) If the internet user is paying by credit card or debit item, the seller gets € 0,51 (incl. VAT) per
minute.
Uploaded video clips are generally paid with € 0,23 per minute.
For each Gallery picture which has been watched by an internet user the seller gets € 0,03.
b) Considerations for the alternative payment possibilities are paid two weeks after the registration.
Payment is happening within one week after settling day.
c) Changing of the common business conditions and prices will be told to the seller in writing. The
changing seem to be accepted if the seller does not terminate the contract within the following four
weeks.
5. Notice of termination of agreement
a) The agreement is made for an indefinite time.
b) The seller obligates after finishing the contract not to give any information and operating data to
unauthorized persons.
6. Exclusion of liability and legal domicile
a) The exclusions of liability are also valid between the German Telekom and the parties.
b) For both parties the legal domicile is Porlamar (Venezuela).
7. Further statements of the seller
The seller explains herewith the following statements:
- That he is at legal age in his country
- He agrees that the owner publishes picture- and sound material which is made available to the owner
by the seller.
- The seller releases the owner from any demands of other persons which could originate in illegal or
immoral performances of the seller.
8. Further conditions
a) The seller is working as an independent staff. He is responsible for his taxes and his charges for
using the internet.
b) The seller is only allowed to use the software in connection with “CAMWORLD.TV”. Private use as well
as manipulation of the software is forbidden. If any technical problems exist, the owner has to be
informed immediately.
§ 13. Duty of behaviour
a) The seller is not allowed to get in private contact with the internet user personally, in writing, by
telephone or in any other kind or to offer private contact with the internet user in any form.
b) The seller engages to keep absolute silence about internal information which he reached during his
activity. He engages especially to keep silence about the place of the performance, names of clients, the
owner’s company, the names of colleagues and all financial conditions and agreements. The
engagement of secrecy stays also with the end of the contract
c) The seller explains that he was informed by the owner, that he is not allowed to make harmful
pictures and text accessible to persons under 18.
d) The seller will finish the connection if he becomes suspicious that a person at not legal age wants to
get in contact through the portal of “CAMWORLD.TV”.
e) The seller engages to make and keep writings, if he has finished a connection because of the above
mentioned backgrounds. He will give this information immediately to the owner.
The minimum pay-off amount inside the European Union is 10.00 Euro, for pay-offs to countries
outside of the European Union 50 Euro. Inside Germany only 5,00 Euro.
